Terms of Service

1. Definitions

In these terms and conditions, the following definitions apply:

  • Cre8ive Lemon: The contractor, based in Didam (The Netherlands), Chamber of Commerce no. 88876667.
  • Client: Any natural or legal person who enters into an agreement with Cre8ive Lemon.
  • Agreement: Any arrangement between Cre8ive Lemon and the Client regarding the delivery of products or services.
  • Products: All digital files, designs, templates, courses, PDFs, manuals, and other digital materials.
  • Services: All activities, advice, coaching, design, and marketing services performed by Cre8ive Lemon.
  • Hour Bundle (Strippenkaart): A prepaid bundle of hours used for assignments from the Client.
  • Subscription: A recurring service (such as social media management) delivered monthly or in packages of 3, 6, or 12 months.

2. Applicability

2.1 These terms and conditions apply to all quotations, agreements, deliveries, and services of Cre8ive Lemon, unless otherwise agreed in writing.

2.2 Deviations are only valid if confirmed in writing by Cre8ive Lemon.

2.3 General (purchase) conditions of the Client are expressly rejected.

3. Offer and formation of the Agreement

3.1 All quotations and offers from Cre8ive Lemon are non-binding and valid for 14 days, unless stated otherwise.

3.2 An agreement is concluded once the Client has confirmed the offer in writing or digitally.

3.3 Cre8ive Lemon reserves the right to refuse assignments without stating reasons.

4. Cooperation and provision of information

4.1 The Client shall provide all documents, data, and materials required for proper execution of the assignment in a timely manner. This may be done via the online briefing form or another agreed method.

4.2 Cre8ive Lemon is not liable for damage arising from incorrect or incomplete information, unless this should reasonably have been apparent.

4.3 Any additional costs or delays resulting from information or materials not being supplied on time or correctly shall be borne entirely by the Client.

5. Changes to the assignment and additional work

5.1 The Client accepts that the schedule may be affected if the parties decide to change the approach, method, or scope of the assignment.

5.2 If interim changes arise due to the Client, Cre8ive Lemon will implement the necessary adjustments in consultation.

5.3 Additional work is considered a supplementary assignment and will be invoiced separately.

5.4 Cre8ive Lemon will not charge additional costs if the change results from circumstances attributable to itself.

5.5 If adjustments are required multiple times due to incorrect or incomplete information provided by the Client (more than twice), additional costs may be charged. This will always be discussed in advance to reach an appropriate solution together.

6. Execution, revisions, and delivery

6.1 Cre8ive Lemon will execute the assignment to the best of its knowledge and ability, in accordance with the standards of good craftsmanship.

6.2 Design assignments include a standard of three (3) revision rounds.

Revisions outside these three rounds are considered additional work and will be invoiced separately.

6.3 If stock photos or premium elements are required for a design, the costs will be discussed with the Client in advance and charged separately.

6.4 Cre8ive Lemon strives to deliver assignments within the agreed timeframe. However, only a delivery date is agreed upon—not a specific time—since rush assignments or other factors may affect the schedule.

6.5 If the Client requires a design at a specific time, this must be communicated in advance to avoid confusion or disappointment.

6.6 When working with international clients, time zone differences must be taken into account. This will be discussed in advance to ensure proper planning and delivery.

6.7 If delivered work may not be included in the portfolio of Cre8ive Lemon due to privacy or confidentiality obligations, this must be indicated at the time of the request.

7. Rates and payments

7.1 All rates of Cre8ive Lemon are exclusive of VAT and any additional costs, unless stated otherwise.

7.2 Rates are determined based on the nature, duration, and complexity of the assignment. Hourly rates, fixed prices, or package prices are agreed upon in advance and confirmed in the quotation or invoice.

7.3 Any price changes will be communicated in advance and in a timely manner. For ongoing projects, hour bundles, or subscriptions, the agreed rate remains valid until the end of the agreed period.

7.4 Invoices must be paid within 14 days of the invoice date.

Exceptions apply only to large projects, for which a payment term is applied as agreed in writing between Cre8ive Lemon and the Client.

7.5 All digital products must always be paid in advance.

7.6 In certain cases, such as medium-sized or large projects, payment in installments based on predefined milestones may be arranged at the Client’s request. This is only possible with approval from Cre8ive Lemon.

7.7 The exact terms, milestones, and payment percentages will be stated on the invoice after consultation and approval.

7.8 Subscriptions for social media management and other monthly services are always invoiced in advance. Invoices are sent on the first day of the month and must be paid immediately and no later than before the start of the new monthly period.

7.9 Delivery of final files, access to digital products, or publication of any design will only take place after full payment has been received.

7.10 Designs, concepts, or files delivered by Cre8ive Lemon may under no circumstances be published, distributed, or used before full payment has been received.

8. Discounts

8.1 Discounts apply to hour bundles: the larger the package, the greater the benefit.

8.2 For social media packages, the longer the duration (3, 6, or 12 months), the greater the discount compared to a monthly cancellable package.

8A. Non-Payment

8A.1 If the Client fails to pay within the stipulated term, they are legally in default without further notice of default being required.

8A.2 From the day the payment term has expired, the Client owes statutory commercial interest (as referred to in Article 6:119a of the Dutch Civil Code) on the outstanding amount.

8A.3 All reasonable costs incurred by Cre8ive Lemon to obtain payment out of court (such as collection and administrative costs) shall be borne by the Client. These costs are calculated in accordance with the Decree on Compensation for Extrajudicial Collection Costs (BIK), with a minimum of €50.

8A.4 If payment is not made, Cre8ive Lemon may suspend the execution of ongoing work or the delivery of materials until full payment has been received.

8A.5 If the Client remains in default despite reminders, Cre8ive Lemon reserves the right to unilaterally terminate the agreement.

8A.6 Any damage or costs arising from suspension or termination due to non-payment shall be borne entirely by the Client.

9. Termination and cancellation

9.1 Since many services are paid in advance, cancellation is usually not possible.

9.2 For social media management, a higher-priced monthly cancellable package applies, or more affordable packages for longer periods, which cannot be cancelled prematurely.

9.3 Projects that have already started and are paid afterward cannot be cancelled.

10. Rush delivery

10.1 A rush delivery applies when the Client requests delivery within 24 to 48 hours for smaller assignments, or within one (1) week for larger projects, deviating from the standard delivery timeframe.

10.2 Rush delivery is subject to availability and must be explicitly agreed upon in writing by Cre8ive Lemon. Cre8ive Lemon reserves the right to refuse rush assignments without stating reasons.

10.3 For rush delivery, an additional surcharge may apply. The amount of the surcharge will be communicated in advance and must be approved by the Client before commencement of the work.

10.4 Approval of a rush delivery implies that the Client provides all required information, materials, and feedback promptly and within the agreed deadlines. Any delay in providing input may result in a postponed delivery without entitlement to a refund of the rush surcharge.

10.5 Rush delivery affects only the delivery timeframe and does not alter the agreed scope of work, number of revision rounds, or quality standards.

10.6 Cre8ive Lemon is not liable for delays caused by circumstances beyond its control, including but not limited to force majeure, third-party dependencies, or delayed input from the Client.

10.7 If a rush delivery has been agreed upon, cancellation or rescheduling by the Client is not possible, and the rush surcharge remains payable in full.

11. Hourly bundles and subscriptions

11.1 Hour bundles are valid for 6 or 12 months and are fully invoiced in advance.

11.2 Hours are rounded up to the nearest quarter hour.

11.3 Refunds of unused hours are not possible.

11.4 Subscriptions are paid in advance and are cancellable monthly, unless a more affordable 3-, 6-, or 12-month package is chosen.

11.5 Results from social media management are often only visible after several months. Cre8ive Lemon recommends a minimum duration of 3 months.

12. Price changes

12.1 Cre8ive Lemon has the right to index its rates annually in accordance with the Consumer Price Index (CPI) of Statistics Netherlands (CBS), or to adjust them in the event of market conditions, rising costs, or changes in legislation.

12.2 Changes will be communicated in advance and in a timely manner.

12.3 For ongoing packages or hour bundles, the agreed rate remains valid until the end of the agreed period.

13. Coaching

13.1 Coaching programs and sessions are paid in advance.

13.2 Coaching is intended as guidance and inspiration; Cre8ive Lemon provides no guarantee of results.

13.3 The Client always remains responsible for decisions and results arising from coaching.

14. Liability and risks

14.1 Cre8ive Lemon is not liable for damage arising from incorrect or incomplete information provided by the Client.

14.2 Liability is limited to the invoice amount for the relevant assignment.

14.3 Cre8ive Lemon is not liable for indirect damage, consequential damage, or loss of profit.

15. Copyright and Intellectual Property

15.1 All designs, concepts, texts, images, and other creations remain the property of Cre8ive Lemon, unless agreed otherwise in writing.

15.2 The Client obtains a right of use for their own brand or personal purposes.

15.3 It is not permitted to modify, edit, or have designs altered by third parties. This may result in financial and reputational damage.

15.4 The Client is liable for all damage suffered by Cre8ive Lemon as a result of unauthorized modification or use by third parties.

15.5 If a third party unlawfully modifies or uses a design by Cre8ive Lemon, that third party may also be held liable.

16. Force Majeure

16.1 In the event of force majeure (such as power outages, illness, internet failures, or other circumstances beyond our control), Cre8ive Lemon has the right to suspend or reschedule work without liability for damages.

17. Privacy

17.1 Cre8ive Lemon processes personal data in accordance with applicable privacy legislation.

18. Complaints

18.1 Complaints must be submitted in writing within 7 days of delivery via branding@cre8ivelemon.com.

18.2 Cre8ive Lemon will investigate the complaint and respond within a reasonable period.

19. Applicable Law

19.1 All agreements are exclusively governed by Dutch law.

19.2 Disputes shall be submitted to the competent court in the district where Cre8ive Lemon is established.
